Let’s say, for example, that you want to start a Non-Storefront, Delivery Business. This may work for you because you don’t have patrons coming into your store on a regular basis and seeking that golden weed. Here, you receive orders by telephone or computer and deliver the Cannabis to a particular location.
In this case, you are going to need a license from the City or County in which your business premises will be located. Also, if you don’t have a particular business property to use for your business premises, you will have to find the property and describe the address and attributes of that property in your City Permit. In other words, you need to lease or purchase the property before seeking the local permit to operate your business.
Yet, it would be helpful to find a premises which will accept a business such as yours since many secured lenders provide in their security documents that no business can be conducted on the premises which is “illegal.” Well, a Cannabis business if properly licensed in California may be “legal”, but a Cannabis business remains illegal under federal law. There remains a conflict between the state and federal law where the business of Cannabis is concerned. So it can be a bit touchy procuring a lease for your shiny new Cannabis business. Perhaps it would be helpful if you
could find a free and clear property…In addition, you may have to pay for months of lease payments before you can get your city license to operate the business. So, you need some sort of escape clause to get out of the lease if for some reason you can’t get the license. After you get the city license, you will need to get the state license in addition. This might take you a year to get this together, maybe longer.
